Terms & Conditions Agora GPS Expeditions SA
Please read these Terms and Conditions (“Terms”) carefully before booking a tour or expedition with Agora GPS Expeditions SA (“Company,” “we,” “us,” or “our”). These Terms govern your relationship with the Company and your participation in any tour or expedition organized by us. By booking a tour or expedition with us, you acknowledge that you have read, understood, and agree to be bound by these Terms.
1. Definitions
1.1. “Company” refers to Agora GPS Expeditions SA (alias Agora Tours Isabela), a tour company offering guided tours and expeditions.
1.2. “Participant” refers to any individual who books or participates in a tour or expedition organized by the Company.
1.3. “Tour” refers to a scheduled trip or expedition organized by the Company.
1.4. “Booking” refers to the reservation or purchase of a tour or expedition offered by the Company.
2. Booking and Payments
2.1. To book a tour, participants must complete the booking process through our official website agora-tours.com. By making a booking, participants agree to pay the specified tour price, including any applicable taxes and fees.
2.2. A deposit or full payment is required at the time of booking, as specified for each tour.
2.3. Payments can be made using direct banking transfer, credit card (via Wetravel or Paypal) or payment in cash in our office. All payments must be made in USD.
2.4. The Company reserves the right to cancel a booking if payment is not received in accordance with the specified terms.
3. Included Services & Itinerary
3.1 The tour packages include only the services and amenities specifically mentioned on our website agora-tours.com. Any additional services or items not explicitly stated are not included. The max. number of passengers refers to passengers per guide. On some boats in Santa Cruz the max. capacity is 20 people with two naturalist guides. The state duration is an average and can depend on daily conditions, group size and restrictions of the National Park.
3.2 Replacement tours free of charge are not part of our services.
3.3 All tours are subject to the rules of the National Park of Galapagos. Any restrictions set by them will be adhered to. The company is allowed to change departures and itineraries due to rule changes.
4. Tour Modifications and Cancellations
4.1. The Company reserves the right to modify, reschedule, or cancel a tour due to unforeseen circumstances or events beyond our control. In such cases, we will make reasonable efforts to provide alternative arrangements or offer a refund.
4.2. The Company may cancel a tour if the minimum number of participants required to operate the tour is not met. In such cases, participants will be offered an alternative tour or a full refund.
4.3. Participants may request to modify or cancel their booking. For modifications, the company must be informed (either by e-mail to [email protected] or by a message to +593 96 938 8095) 5 days in advance about any modification. If not informed, the company will not be liable for any costs occurring. If the customer can not attend the tour as planned for any reason outside of the company’s power (including sickness) it is handled as a Cancellation. Cancellations are subject to the following refund policy:
– Over 2 weeks prior to trip: 100% refund.
– 10 days before: 50% refund.
– 4 days prior to the trip or closer: no refund possible.
– Tours with discounts are non-refundable.
– Tours on Santa Cruz are subject to the cancellation policies of the boat owners. Please ask for the exact cancellation policy before booking.
5. Participant Responsibilities
5.1. Participants are responsible for providing accurate and complete information during the booking process (full name of all participants, hotel and food requirements as well as passport numbers if required). Any changes or updates to participant details must be promptly communicated to the Company. If the information is not provided within 24 hours before the tour the Company has the right to cancel the arrangement.
5.2. Participants must ensure that they possess the necessary travel documents, including valid passports, visas, and permits, required for the tour. The Company is not liable for any expenses or consequences resulting from inadequate or incorrect travel documents.
5.3. Participants are responsible for obtaining adequate travel insurance coverage for the duration of the tour. The insurance should include coverage for medical expenses, trip cancellations, and personal belongings.
5.4. Participants are responsible for complying with all applicable laws, regulations, and customs of the countries visited during the tour. The Company reserves the right to exclude any participant from the tour if their conduct is deemed to be disruptive or in violation of these Terms or local laws.
6. Health and Safety
6.1. Participants are responsible for assessing their physical fitness and suitability for the chosen tour. It is recommended to consult a healthcare professional before participating in physically demanding tours or expeditions.
6.2. Participants must inform the Company of any pre-existing medical conditions, allergies, or dietary restrictions that may affect their ability to participate fully in the tour. The Company will make reasonable efforts to accommodate such requirements but cannot guarantee their fulfilment.
6.3. Participants must follow the instructions and guidelines provided by the Company’s tour guides or representatives for their own safety and the safety of others.
7. Limitation of Liability
7.1. The Company and its employees shall not be liable for any personal injury, property damage, loss, delay, or additional expenses incurred by participants during the tour, unless caused by the Company’s negligence or willful misconduct.
7.2. The Company shall not be liable for any losses or damages resulting from force majeure events, including but not limited to natural disasters, acts of terrorism, civil unrest, or transportation disruptions.
7.3. In no event shall the Company’s total liability for any claim arising under these Terms exceed the amount paid by the participant for the affected tour.
8. Intellectual Property
8.1. The Company retains all intellectual property rights related to its tours, including but not limited to photographs, videos, itineraries, and promotional materials. Participants must not use, reproduce, or distribute such materials without the Company’s prior written consent.
9. Photography and Media
9.1. We may take photographs or videos during the tour for promotional purposes. By participating in the tour, you grant us the right to use such media for marketing and advertising purposes without requiring further consent or compensation.
10. Governing Law and Jurisdiction10.1. These Terms shall be governed by and construed in accordance with the laws of Ecuador and the Galapagos Islands, where Agora GPS Expeditions SA is registered.
10.2. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in Ecuador and the special law of the Galapagos Islands.
11. Severability
11.1. If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.
12. Amendments
We reserve the right to modify or amend these Terms & Conditions at any time. Any changes will be effective immediately upon posting on our website. It is your responsibility to review the Terms & Conditions periodically for updates.
13. Entire Agreement
This Agreement constitutes the entire understanding and agreement between Agora GPS Expeditions SA and the customer, superseding any prior agreements, discussions, or representations, whether oral or written.
By booking a tour with Agora GPS Expeditions SA (alias Agora Tours Isabela), you acknowledge that you have read, understood, and agree to abide by these Terms and Conditions.
